What is mediation?
Mediation is a way for you and the other party to settle a dispute amicably without a hearing at IPOS. An external mediator will help the parties to communicate, and work out a win-win solution based on both parties’ interests. A mediated solution is owned by the parties, unlike the Registrar’s decision after a hearing, which is imposed on the parties.
Why try mediation?
You can choose a mediator who has IP expertise and experience. Service providers such as WIPO Arbitration and Mediation Center and Singapore Mediation Centre have specialist IP panels of mediators (see further below).
You have control and certainty over the process, leading to time and cost savings. For example, you can harness technology to lower costs e.g. video-conferencing.
You can discuss related disputes, for a holistic resolution of all disputes between the parties
You can come up with creative win-win outcomes based on business or personal interests
Mediation is confidential so frankness and openness is encouraged, and your reputation is protected
You can end the mediation at any stage, allowing you to manage the time and cost involved (but parties usually take part actively in the mediation once it starts)
What are some possible mediated solutions?
A trade mark opposition / invalidation based on absolute grounds may be settled with the applicant (or registered proprietor) agreeing to stop the use of the sign in question and to withdraw the application (or cancel the registration); and parties collaborate to launch a new collective trade mark.
A trade mark revocation may be settled with a sale of the registered mark by the registered proprietor to the applicant for revocation. The registered proprietor then uses the proceeds of the sale to fund other business pursuits.
A patent entitlement dispute may be settled with an agreement between the parties to be recognized as joint proprietors and to pool their resources and bid for a lucrative tender that the patent could be used for.

Who will mediate my dispute?
You can use a mediation provider and a mediator of your choice.
The WIPO Center is the only global mediation provider specializing in IP and IT disputes. With a Singapore Office established in 2010, it is readily accessible to parties. The WIPO Center can help you to shortlist potential mediators who meet your criteria and the requirements of the dispute.

Choosing WIPO Mediation in IPOS Proceedings
Fees for WIPO Mediation
The WIPO Center is non-profit, and requires only a low administration fee that has been heavily discounted under our collaboration. To further keep costs low, the parties can choose to mediate at the WIPO Singapore Office (29 Heng Mui Keng Terrace, #06-16, Singapore 119620) free of charge.

(*) Based on the WIPO Center's experience, an average WIPO trade mark mediation involves up to 15 hours.
Starting WIPO Mediation
You can request for WIPO Mediation at any time before we decide on the outcome of the case. You will be given time to specifically consider your dispute resolution options, after the pleadings (Statement of Grounds and Counter-Statement) have been filed, before completing and returning to us a signed Notification to Registrar. Both parties agree to mediate
You wish to propose mediation to the other party
Both parties jointly complete one Request for WIPO Mediation
Either party sends the Request for WIPO Mediation to the WIPO Center Office in Singapore by email (email@example.com), as well as to the other party and IPOS
The WIPO Center will contact the parties about the next steps of the mediation procedure, the appointment of the mediator and the mediator's fees
You complete sections 1, 2 and 3a of the Request for WIPO Mediation
You send the Request for WIPO Mediation to the WIPO Center Office in Singapore by email (firstname.lastname@example.org), as well as to the other party and IPOS
The WIPO Center will approach the other party to help them in considering the Request for WIPO Mediation
Once you let us know of your intention to mediate, we will generally suspend the IPOS proceedings for mediation to take its course.
