For Registration Under Paragraph 11 Of Third Schedule Of The Trade Marks Act 1998
The Registry wishes to remind all applicants and agents that the last day to give the Registrar notice of conversion of pending applications for registration of trade marks specified in paragraph 11(2) of the Third Schedule of the Trade Marks Act 1998 is Thursday, 15 July 1999.
Only pending applications for registration made under the repealed Trade Marks Act and which have not been advertised under Section 18 of the repealed Act can be converted. The consequence is that the registrability of these marks will be determined in accordance with the provisions of the Trade Marks Act 1998. Reference is made to paragraph 11(1) of the Third Schedule of the 1998 Act.
To give the Registrar notice of conversion, please file Form TM 47 and pay a fee of $150 for each application that is intended to The Registry hopes that all notices for conversion will be filed with the Registry well in advance before 15 July 1999.
