Trade Marks (Amendment No. 4) Rules 1997

Amendment of Trade Marks Rules - Deletion of Rules 67-70 and Substitution of Rules 67 and 68

Under the amended Rule 67 of the Trade Marks Rules, an application for assignment must be signed by all parties concerned. It is no longer necessary to lodge the assignment document in writing if the parties are able to execute the authorisation in the form. However, if the parties involved are unable to execute the authorisation, they may lodge a certified copy of the assignment document as proof.

Alternatively, if even that cannot be done, they would be required to lodge a Statement of Case setting out the facts and showing the passing of title and the Statement of Case must be verified by a Statutory Declaration.

Amendment of Second Schedule

Forms TM 22 and TM 37 are to be replaced. For more details on the amendment, please refer to Gazette no. S540/97, which may be obtained from the SNP Corporation Ltd.
