A.  Amendments to Subsidiary Legislation

Registered Design (Amendment) Rules 2005

The following is a summary of some of the amendments proposed in the Registered Designs (Amendment) Rules 2005 which is targeted to come into force on 1 September 2005:

Introduction of the Online Filing System
The amendments to the Registered Designs Rules are primarily for the introduction of online filing of designs and for the operation of electronic online system. The amendments include:
  • Amendment to Rule 3A - insertion of a new sub-rule (6) which allows the Registrar to require the filing of a hard copy of any document filed using the electronic online system.
  • Amendment to Rule 4 - forms may be modified for use in relation to thee online system
  • Introduction of a New Part VIIIA for established an electronic online system for the purposes of these Rules.
The electronic online system may be used for carrying out transactions relating to:
  • applications for registration of a design under Section 11 of the Act (Form D3);
  • requests to change or correct the name and/or address of an applicant for registration or of a registered proprietor; or request to change an address for service (Form D1);
  • appointments or substitutions of agents under Rule 8(3) (Form D2);
  • amendments to an application for registration of a design or applications to correct an error in the Register (Form D5);
  • applications for a certified copy of an entry in the Register or a certified extract from the Register under Section 55 (3) of the Act (Form D7);
  • applications for extension of period of registration of a design under Section 21 of the Act and paragraph 3 (6) of the Schedule to the Act (Form D8); and
  • requests for an extension of time (Form D16).

Service of Documents
Rule 6 has been amended to include the service by facsimile of documents which are not fee payable. Service by facsimile however is not allowed for the filing of statutory declarations under Rules 42(1), 43(1) or 44(1).

Issuance of the Certificate of Taxation
A new rule, Rule 56E, is introduced to allow requests for the issuance of the Certificate of Taxation after a bill of costs has been taxed. Correspondingly, a new form D19 for extracting the certificate of taxation is introduced.

Representations of a Design
Rule 14 has been amended to state that the requirement of the number of copies of representations that is to be filed will be made via practice directions.

Amendment of Rule 57
Rule 57 is amended to clarify that an extension of time may not be requested to extend time beyond the six month grace period granted for the renewal of a design or a relevant design.

Hours of Business and Excluded Day
Rule 59 is amended to clarify when a transaction via the electronic online system is considered to be received if the deadline for the transaction falls on an excluded day. The amendment also clarifies when a document which is filed using the online system is treated as having been sent to or filed with the Registry.

Similarly, Rule 59 is also amended to clarify when a document which is sent via facsimile is considered to be sent to or filed with the Registry.

Extension of period where interruption in postal service, etc.
Rule 60A is amended to include interruptions to the operation of the electronic online system.

Fees
The fees for online filings and over-the-counter (manual) filings are shown in the Annex A.

B. Search of Designs Register

With effect from the 1st September 2005, searches of the Designs register will be available via the eDesigns online search system.

C. Publication of Designs Journal online

With effect from the 1st September 2005, the Designs Journal will be published online and will be downloadable without charge from the Intellectual Property Office’s website at www.ipos.gov.sg
